Statutes of the Kurash Confederation of ASIA

Composition and Goals of KCA

1.  

Definition

1.1. 

The Kurash Confederation of ASIA, referred to herein as the KCA shall be the non-political and non-profit international organization founded on the Islamic Republic of IRAN and composed of the Asian National Kurash Federations affiliated to the KCA.

1.2. 

The KCA shall equally respect the rights and interests of all officially affiliated National Kurash Federations, referred to herein as the NKF.

1.3. 

The KCA in its actions and decisions shall not use any discriminatory approach including discrimination on basis of nationality, religion, sex, political, cultural and other preferences. Hereinafter in cases, if there is not a special mentioning of the contrary, the masculine gender used in relation to any person shall be comprehended as including the feminine gender as well.

1.4. 

The governing bodies of the KCA shall be the Congress and the Directing Committee.

 

 

2.  

The sport of the KCA

2.1. 

The KCA shall be an official international body governing and representing on international arena the sport of Kurash, the native ancient type of sport practiced by people of Uzbekistan. The present look of Kurash is based on the Kurash Rules created by Komil Yusupov - the main initiator of the IKA's foundation.

2.2. 

The KCA shall be open for collaboration equally for all organizations and sports which are ready to promote and cooperate with the sport of Kurash.

 

 

3.  

Aims

3.1. 

The main aim of the KCA shall be the worldwide promotion and protection of interests of Kurash and its values.

3.2. 

Taking under account interests of the NKF, the KCA shall promote ideas of peace, friendship and mutual understanding.

3.3. 

KCA shall coordinate and supervise Kurash development around the world.

3.4. 

The KCA shall coordinate holding of various international sporting events, including Continental Championships, Tournaments and Cups, other sport competitions, Continental training camps and seminars for referees, coaches and athletes of both sexes of all age and weight categories mentioned in the International Kurash Rules.

3.5. 

The KCA shall support and maintain the ideals and objectives of the Asian Games Movement.

 

 

4.  

Headquarters and Official Languages

4.1. 

The Headquarters of the KCA shall be located in the place as determined by the Congress of the KCA.

4.2. 

The official languages of the KCA shall be English.

All official documents and correspondence shall be written in the official languages. The official meetings of the KCA including Congress and Directing Committee meetings shall use the official languages.

4.3. 

In case of disagreement over interpretation and translation, the language originally used in the documents and correspondence shall prevail.

4.4. 

In case of disagreement over interpretation of technical matters of Kurash, the Uzbek language shall prevail.

 

 

5.  

Flag, Emblem and Anthem

5.1. 

The Flag, the Emblem and the Anthem of the KCA shall be approved by the Congress of the IKA.

5.2. 

The Flag, the Emblem and the Anthem of the KCA shall be an exclusive property of the KCA and shall not be used by third parties without the prior approval of the Directing Committee.

5.3. 

The Flag, the Emblem and the Anthem of the KCA shall be used during all official sporting events of the KCA.

6.  

National Kurash Federations, their rights and obligations

6.1. 

The KCA shall unite Asian Kurash Federations - official members of the KCA, which are officially affiliated to the KCA.

6.2. 

Every single country shall be represented individually.  

6.3. 

The NKF shall be responsible for promotion and development of Kurash and for the position of Kurash in their countries. The information about that on constant basis shall be reported by the NKF to the respective KCA.

6.4.

6.5. 

The Statutes and the By-Laws of the NKF shall be drafted in accordance with the Statutes and the By-Laws of the KCA. The Statutes and the By-Laws of the NKF shall not contradict to the Statutes and the By-Laws of the KCA.

6.7. 

The NKF applying for membership in the KCA shall present the following set of documents, all written or translated into one of the official languages of the KCA, to the General Secretary of the KCA:

  • a written request for membership signed by the NKF President
  • a copy of the NKF's Statutes
  • a copy of the NKF's registration certificates
  • a letter stating agreement with the Statutes and the By-Laws of the KCA and obligation to follow them
  • the list of the NKF's officials including their full mailing addresses and contact telephone and facsimile numbers
  • a cheque made out in US dollars for the sum of the entering fee and membership fee for the first year of membership

6.8. 

The above mentioned set of documents shall be submitted to the General Secretary of the KCA at least six months prior to the next Congress meeting.

6.9. 

The General Secretary shall present the submitted documents for the discussion at the next Directing Committee meeting. If the submitted documents comply with requirements of the KCA the Directing Committee shall include to the Agenda of the next Congress the question on affiliation of the applying NKF to the KCA.

6.10. 

The NKF shall become a member of the KCA if the simple majority of the Congress members votes in favor.

6.11. 

The NKF officially affiliated to the KCA shall have the right to attend and speak at all Congress Meetings, nominate its candidates to all official positions in the KCA and vote on all questions included to the Agenda of the Congress.

6.12. 

The NKF may withdraw its membership from the KCA by submitting a written request to the General Secretary, who shall present it to the next Congress meeting. The Congress shall cancel the membership of the NKF submitting the request.

 

 

8.  

Annual membership fee

8.1. 

The NKF shall pay to the KCA the entrance fee in amount of US $ 300. Annual membership fee of the NKF in amount of US $ 300 shall be payable by 31st December each year.

8.2. 

Any NKF that has not paid its annual fee is liable for suspension from all official competitions and meetings of the KCA, including the Congress meetings, until the said payments are duly made by the NKF.

8.3. 

In case the NKF delay payment of the annual membership fee for more than a year, the NKF shall be expelled from the KCA.

 

 

9.  

Expulsion, resignation and suspension

9.1. 

The NKF shall be expelled from the KCA in following cases:

  • expulsion from its KCA
  • resignation
  • failure to pay the annual membership fee
  • activities conflicting with the Statuses and the By-Laws of the KCA
  • refusal to comply with the KCA decisions
  • actions against Kurash development

9.2. 

The final decision to expel the NKF from the KCA (except cases of resignation and non- payment of annual membership fee) may only be obtained at the KCA's Congress meetings by a two-third majority vote.

9.3. 

Any NKF which has resigned or has been expelled from the KCA and later wishes to rejoin the KCA will have to pay a re-entry fee twice the amount of the membership fee it would have had to pay had it remained a member.

9.4. 

A member NKF may not claim any damages against the KCA.

 

 

10.  

Finances

10.1. 

The KCA's incomes shall be as follows:

  • Entrance fees
  • Annual membership fees
  • Donations
  • Sponsors' license fees
  • Rights for TV broadcast of KCA's official events
  • Financial support from the World Foundation on Kurash Development
  • Other sources

10.2. 

The members of the Directing Committee and Commissions, as well as other staff of the KCA shall offer their services to the KCA free of charge, unless otherwise stated by the Statutes and the By-Laws of the KCA. However, their travelling and living expenses while on official out-station duty will be reimbursed by the KCA.

10.3. 

All TV and Radio broadcasting, film, photo, contractual and property rights of the World and Continental Championships of the KCA are the exclusive property of the KCA. The rights may not be negotiated or sold without a written agreement of the President of the KCA, who may delegate his authority to manage and sell these rights, but who shall retain the sole responsibility for the final decision and for the use of the income from the sale of the rights. All saleable rights are to be reflected by the Treasurer in income and expenditure statements.

10.4. 

The fiscal period for financial and accounting purposes shall be a period of one calendar year from 1st January to 31st December of the said year.

10.5. 

The Treasurer shall submit to the Congress and the Directing Committee the accounting report of the past Fiscal Year at the first meeting of the Congress and the Directing Committee which is subsequently nearest to 31st December of said year.

10.6. 

The Treasurer shall consult with the President, the Congress and the Directing Committee for recommending an internationally acceptable public accounting firm of Chartered Accountants for the auditing of the KCA accounts prepared under the supervision of the Treasurer. The Treasurer shall be responsible and shall oversee the auditing done by the selected accountants and place the audited statements before the Congress and the Directing Committee at the first meeting of the Congress after the completion of the yearly audit for approval. A representative from the firm of accountants may be invited to attend the Congress/Directing Committee meeting at the discretion of the Treasurer with the approval of the President of the KCA.

 

 

   The Congress

11.  

Composition

11.1. 

The Congress shall be the Supreme Governing Authority of the KCA.

11.2. 

The members of the Congress shall be the NKF - official members of the KCA, and the members of the Directing Committee of the KCA.

11.3. 

Each NKF may delegate up to two representatives to the Congress meeting, but only one of them shall have the right to vote and speak at the Congress meeting.

11.4. 

The representatives of the NKF with the right to vote at the Congress must present formal credentials signed by the NKF's President to the General Secretary before the opening of the meeting of the Congress. In case if the delegate is the President of the NKF, he shall not need to present such credentials.

11.5. 

The Directing Committee may invite observers to take part at the Congress meeting. The said observers shall have no right to take part in discussions during the meeting. Observers may address the speech to the Congress only with permission of the Congress' Chairperson.

11.6. 

The Congress meeting shall be eligible to start if more then a half of the Congress members are present including those represented by proxies.

11.7. 

The Congress meeting shall be chaired by the President of the IKA. In case if the President is unable to take part at the meeting, the Congress shall be chaired by one of the members of the Directing Committee elected by simple majority of votes of Congress members.

11.8. 

The Congress meeting shall be eligible to discuss and vote only on the questions included to the Agenda of the Congress. The Agenda of the Congress shall be drafted by the Directing Committee of the KCA and approved by the Congress members in the beginning of the meeting.

 

 

12.  

Proxies  

12.1. 

The Congress members who due to some reasons cannot take part at the Congress meetings may delegate their right to speak and vote at the Congress to the other member of the Congress via a duly authorized proxy of the fixed form.

12.2. 

The Congress members shall present proxies to the General Secretary before the start of the Congress meetings.

12.3. 

The proxies shall be of the type designated by the By-Laws of the KCA and must be signed by the President of the NKF or the Directing Committee member issuing the proxy. The proxy issued by the NKF must have the seal of the NKF on it.

12.4. 

The proxies shall not be accepted if they do not correspond to requirements mentioned above.

 

 

13.  

Voting procedure

13.1. 

The Congress shall make the decisions by simple majority of cast votes, which means fifty per cent of votes plus one vote, unless otherwise stipulated by the Statutes and the By-Laws of the KCA.

13.2. 

The voting at the Congress meeting shall be made openly by raising hands. In case if demanded by three and more members and if it is approved by one third of the Congress members, voting shall be a secret ballot.

13.3. 

In cases if the number of votes cast for and against is equal the vote of the President of the KCA shall have the decisive character.

 

 

14.  

Activity and Duties of the Congress

14.1. 

The Congress meeting shall be held every year at the same time and venue as the World Championship is to be held.

14.2. 

At least four months before the Congress meeting the members of the Congress shall send to the General Secretary the items they would like to be included to the Agenda of the Congress. The General Secretary shall present the proposals from the Congress members to discussion of the Directing Committee.

14.3. 

The Directing Committee shall draft the Agenda of the Congress at least two months before the Congress meeting. The General Secretary shall circulate the agenda of the Congress among the members of the Congress at least one month before the Congress meeting.

14.4. 

Right after the end of the Congress meeting the General Secretary shall draft the Congress Outline, which shall include short description of main issues discussed by the Congress and the list of decisions made by the Congress. The Congress Outline shall be signed both by the President and the General Secretary. The General Secretary shall circulate the Congress Outline among the Congress members within two weeks after the Congress meeting.

14.5. 

The General Secretary shall draft the minutes of the Congress. The draft minutes shall be circulated among the members of the Congress within six months after the Congress meeting. The next Congress meeting shall discuss and approve the minutes.

14.6. 

The Congress shall do the following:

  • elect the Directing Committee members (except Vice-Presidents and Treasurer)
  • approve, change and amend the KCA’s Statutes
  • approve the Calendar of the Events of the KCA
  • approve the Minutes of the previous Congress meeting
  • hear and approve reports of the Directing Committee's members
  • grant and expel membership of national federations in the KCA
  • grant "Honorary Member of the KCA", "Honorary Member of the Directing Committee of the KCA", "Honorary Vice President of the KCA", "Honorary President of the KCA" awards.

15.  

Extraordinary Congress meeting

15.1. 

An Extraordinary Congress meeting shall be called in following cases:

  • Upon request of at least a half of the Directing Committee members with clear reasons for gathering
  • Upon request of at least a half of the member NKF with clear reasons for gathering.
  • Upon decision of the KCA's President.

The request shall be sent to the General Secretary, who shall inform the President about such request.

15.2. 

The President of the KCA shall designate the date, time and venue of the Extraordinary Congress meeting. The date of the Extraordinary Congress shall be within four months following the receipt of the request.

15.3. 

The Agenda drafted by the Directing Committee shall include only the issues which where the reason of calling of the Extraordinary Congress meeting. Issues that are not included in the Agenda of the meeting shall not be discussed

15.4. 

The status and the validity of decisions made by the Extraordinary Congress meeting shall be equal to the Ordinary Congress' decisions. The procedure of holding and other regulations related to the Extraordinary Congress meeting shall duly comply with the respective conditions of the Ordinary Congress.

 

 

   The Directing Committee

16.  

Members

16.1. 

The Directing Committee shall be a governing body of the KCA, which governs the KCA and makes decisions related to the KCA activity in the period between the two Congress meetings.

The members of the Directing Committee shall be as follows:

  • President
  • General Secretary
  • Secretary
  • Treasurer
  • Sports Director
  • Refereeing Director
  • Director on relations with international sport organizations
  • Director on legal issues
  • Press Director

16.2. 

The Directing Committee meetings shall be held at least once a year. The dates and venues for the Directing Committee meetings shall be designated by the President of the KCA. The General Secretary shall inform the members of the Directing Committee about the date and venue of the Directing Committee meeting at least two months before the said meeting.

16.3. 

The Directing Committee meetings shall be chaired by the President of the KCA. In case if the President is unable to take part at the meeting, the Directing Committee meeting shall be chaired by one of the members of the Directing Committee elected by simple majority of votes of Directing Committee members. The Directing Committee meeting shall be valid if more then a half of the members are present at the said meeting.

16.4. 

Any Directing Committee member who fails to attend without reasonable excuses three consecutive Directing Committee meetings shall be expelled from his position of the Directing Committee member.

16.5. 

In case if the member of the Directing Committee is unable to attend the Directing Committee meeting due to a reasonable excuse, he may delegate his authority to the other member of the Directing committee by giving the proxy or sending the respective notification to the General Secretary by fax at least one week before the Directing Committee meeting.

16.6. 

In case if the Honorary President is unable to attend the Directing Committee meetings, his authority shall be represented by the President of the KCA.

16.7. 

The Directing Committee members shall be responsible for duly accomplishment of activities entrusted them by the Statutes and the By-Laws of the KCA, Congress and Directing Committee decisions, and the personal tasks of the President of the KCA.

16.8. 

The Directing Committee members shall send to the General Secretary items they want to be included to the Agenda of the next Directing Committee meetings at least two weeks before the date of the said meeting. The General Secretary shall present the said items to the President of the KCA who makes the final draft of the Agenda. The General Secretary shall circulate the Agenda among Directing Committee members at least one week before the date of the Directing Committee meeting.

16.9. 

The Directing Committee meetings shall discuss only those issues included to the Agenda of the meeting. The new items may be included to the Agenda during the meeting if the simple majority of the members decide so.

16.10. 

In case if the scheduled meeting of the Directing Committee due to some reasons may not be held, the decisions may be made by written or verbal communications among the members of the Directing Committee. The validity of such decisions shall be equal with the decisions made during the Directing Committee meetings.

16.11. 

No member of the Directing Committee (except Honorary President and President) shall act, speak and take any commitments on behalf of the KCA before the third parties without prior agreement from the President of the KCA.

 

 

17.  

Voting procedure

17.1. 

All decisions in the Directing Committee shall be made by simple majority, which means fifty per cent of votes plus one vote. In case of tie, the President of the KCA shall have the decisive vote.

17.2. 

The voting during the Directing Committee meetings shall be held openly, by raising hand.

 

 

18.  

Election

18.1. 

The term of office of the Directing Committee members (except the Honorary President) shall be four years.

18.2. 

The Directing Committee members may be re-elected after the completion of their terms.

18.3. 

Nominations to the post of the Directing Committee member shall be sent to the General Secretary at least six months before the next Congress meeting. The nomination letter shall be sent by the NKF nominating the candidate and shall be signed by the President of the NKF. The nomination letter shall be accompanied with the Resume of the candidate and the outline of his program of activity on the sought position of the Directing Committee member.

18.4. 

The General Secretary shall circulate among the members of the Congress the nomination letters, resume and the program outline of the candidates together with other documents of the Congress in terms prescribed by the Statutes of the KCA.

18.5. 

The President of the KCA shall have the right to nominate his candidates to the posts in the Directing Committee of the KCA.

18.6. 

Nominations for the post of the Directing Committee member shall be done only in the way prescribed by the Statutes of the KCA. Nominations done in any other way shall not be accepted.

 

 

19.  

Documents

19.1. 

Right after the end of the Directing Committee meeting the General Secretary shall draft the Outline of the said meeting, which shall include short description of main issues discussed and the list of decisions made. The Outline shall be signed both by the President of the KCA and the General Secretary. The General Secretary shall circulate the Outline among the Directing Committee members within one week after the Directing Committee meeting.

19.2. 

The General Secretary shall draft the minutes of the Directing Committee meeting. The draft minutes shall be circulated among the members of the Directing Committee before the next Directing Committee meeting, during of which the draft minutes shall be approved. The approved Minutes shall be circulated among the NKFs.

 

 

20.  

Duties of the Directing Committee

20.1. 

The Directing Committee and its members shall fulfill the duties reflected in the Statutes and the By-Laws of the KCA.

20.2. 

The members of the Directing Committee shall present reports of activity to each Congress meeting of the KCA. The report shall include the description of the work done by the member and his proposals on how to improve the situation in the field the member is responsible for.

 

 

21.  

By-Laws

21.1. 

The By-Laws shall be developed, adopted and changed by the Directing Committee. The By-Laws adopted or changed by the Directing Committee shall be taken into account by the Congress of the KCA. The By-Laws come into effect right after their adoption by the Directing Committee of the KCA. Only the Directing Committee may change or cancel the By-Laws. The By-Laws lose their power right after the respective Decision is adopted by the Directing Committee of the KCA.

21.2. 

The By-Laws shall be the supplementary additions to the articles and paragraphs of the KCA's Statutes. The power of the By-Laws shall be equal with the power of the KCA's Statutes.

21.3. 

The Congress, the Directing Committee, the NKF and all other organs and employees of the KCA shall fully obey and follow the By-Laws.

 

 

22.  

President

22.1. 

The President shall be elected by the two thirds of votes of the Congress.

22.2. 

The President shall chair all Congress and Directing Committee meetings.

22.3. 

In cases if the voting during the Congress and Directing Committee meetings is tie, the vote of the President shall be decisive.

22.4. 

The President shall receive the reimbursement for all expenses connected with representative activity and travelling for the KCA.

22.5. 

The President shall receive and decide on applications from the members of the Directing Committee and the Commissions of the KCA concerning the reimbursement of expenses which incurred during the performance of their assigned duties.

22.6. 

The President shall have the right to propose to the Congress amendments and changes to the Statutes of the KCA. 

22.7. 

In case if disputes occur over matters not specified in the Statutes or matters that require urgent solution in the period between the two Congresses, the President shall take emergency measures and report about them to the next Congress meeting.

22.8. 

The President shall entrust to the members of the Directing Committee and Commissions of the KCA the duties and tasks related to respective fields of activity of the said members.

22.9. 

The President shall have a right to create his administration, which fulfills his assignments and is led by the President, and financed from the budget of the KCA.

22.10. 

The rights and duties of the President shall be as designated by the Statutes and the By-Laws of the KCA.

 

 

23.  

General Secretary

23.1. 

The General Secretary shall be elected by the Congress of the KCA.

23.2. 

The General Secretary shall act as a liaison between the President of the KCA and the NKF, members of the Directing Committee and Commissions

23.3. 

The General Secretary shall establish close cooperative ties with the NKF, the members of the Directing Committee and Commissions of the KCA.

23.4. 

The General Secretary shall be responsible for administrative issues in the KCA, as well as for circulation of information and correspondence as prescribed by the Statutes and the By-Laws of the KCA.

23.5. 

For the efficient accomplishment of the prescribed duties the General Secretary with prior permission of the KCA's President shall form a Secretariat. The Secretariat shall employ on the contract basis needed number of workers and shall be headed by the General Secretary. The Secretariat shall be financed from the budget of the KCA. The Secretariat shall be located in the city of residence of the General Secretary of the KCA.

23.6. 

The General Secretary shall sign with prior permission of the KCA's President official documents and correspondence of the KCA.

23.7. 

The General Secretary shall control the proper fulfillment of the KCA's Statutes, the By-Laws and assignments of the KCA's President by the NKF, members of the Directing Committee and Commissions and report about the abuses to the President of the KCA.

23.8. 

The rights and duties of the General Secretary shall be as designated by the Statutes and the By Laws of the KCA.

 

 

24.  

Secretary

24.1. 

The Secretary shall be elected by the Congress of the KCA.

24.2. 

The Secretary shall closely collaborate and assist in all issues to the General Secretary.

24.3. 

In case of necessity the Secretary shall replace temporary the General Secretary at all meetings of the KCA and in all duties granted to the General Secretary by the Statutes and the By-Laws of the KCA.

24.4. 

The rights and duties of the Secretary shall be as designated by the Statutes and the By Laws of the KCA.

 

 

25.  

Treasurer

25.1. 

The person who occupies the post of the Chairman of the World Foundation on Kurash Development shall be the Treasurer of the KCA.

25.2. 

The Treasurer shall be responsible for the Treasury of the KCA and shall be responsible for keeping regular accounts, and shall work as directed by the President of the KCA.

25.3. 

All incomes and expenses must be recorded and included by the Treasurer to the budget approved by the Congress and the Directing Committee of the KCA.

25.4. 

The Treasurer shall elaborate and propose to the Directing Committee and the Congress a draft of the annual budget of the KCA, and after approval of the said budget shall fulfill it. Any expenses which occur after approval of the budget shall be covered with the prior permission of the President of the KCA.

25.5. 

The Treasurer shall report through the President, a report on the financial situation of the KCA at every Congress and Directing Committee meetings.

25.6. 

The rights and duties of the Treasurer shall be as designated by the Statutes and the By-Laws of the KCA.

 

 

26.  

Sports Director

26.1. 

The Sports Director shall be elected by the Congress.

26.2. 

The Sports Director shall be responsible for all sporting issues in the KCA. He shall control the effective and correct functioning of the competition system at the official sport events of the KCA.

26.3. 

The Sports Director shall lead all issues related to doping control in the KCA.

26.4. 

The Sports Director shall submit to consideration by the KCA's Congress his proposals on improving the International Kurash Rules.

26.5. 

The Sports Director shall be responsible for developing and controlling the programs of the training camps and seminars for coaches and athletes organized in frameworks of the KCA.

26.6. 

The Sports Director shall collaborate closely in all aspects of his activity with the President of the International Kurash Association.

26.7. 

The rights and duties of the Sports Director shall be as designated by the Statutes and the By Laws of the KCA.

 

 

27.  

Refereeing Director

27.1. 

The Refereeing Director shall be elected by the Congress.

27.2. 

The Refereeing Director shall be responsible for all issues related to refereeing matters at the official sport events of the KCA.

27.3. 

The Refereeing Director shall submit to consideration by the KCA's Congress his proposals on improving the International Kurash Rules in the parts connected with refereeing.

27.4. 

The Refereeing Director shall be responsible for developing and controlling the programs of the refereeing seminars organized in frameworks of the KCA.

27.5. 

The Refereeing Director shall be responsible for drafting the list of the International referees of the KCA.

27.6. 

The Refereeing Director shall collaborate closely in all aspects of his activity with the President of the International Kurash Association.

27.7. 

The Refereeing Director shall collaborate closely in all aspects of his activity with the President of the International Kurash Association.

 

 

28.  

Director on relations with international sport organizations

28.1. 

The Director on relations with international sport organizations shall be elected by the Congress.

28.2. 

The Director on relations with international sport organizations shall be responsible for establishing cooperative and working relation with international sport organizations.

28.3. 

The Director on relations with international sport organizations together with the General Secretary shall be responsible for developing the registration documents and making necessary efforts to register the KCA in the international sport organizations, which represent interest for the KCA.

28.4. 

The Director on relations with international sport organizations in his prescribed activity shall closely cooperate and coordinate his activity with the President of KCA.

28.5. 

The rights and duties of the Director on relations with international sport organizations shall be as designated by the Statutes and the By Laws of the KCA.

 

 

29.  

Director on legal issues

29.1. 

The Director on legal issues shall be elected by the Congress.

29.2. 

The Director on legal issues shall control the conformity of the Statutes, the International Kurash Rules, the By-Laws and all other legal documents of the KCA with the general requirements of international laws and standards.

29.3. 

The Director on legal issues shall propose amendments or changes to the Statutes, International Kurash Rules, the By-Laws and other legal documents so they duly comply with general requirements of international laws and standards.

29.4. 

The Director on legal issues shall closely cooperate and consult with the KCA's President on his actions and decisions in frameworks of the KCA.

29.5. 

The rights and duties of the Director on legal issues shall be as designated by the Statutes and the By-Laws of the KCA.

 

 

30.  

Press Director

30.1. 

The Press Director shall be elected by the Congress.

30.2. 

The Press Director shall be responsible for development and fulfillment of promotional and PR activity aimed at general popularization of Kurash worldwide.

30.3. 

The Press Director shall establish close cooperative and working ties with media sources for ensuring wide coverage of the KCA's events and general promotion of Kurash.

30.4. 

The Press Director shall closely collaborate with media coordinators in the NKF and the CKF in order to ensure wide coverage of the KCA's events and general promotion of Kurash in respective countries and continents.

30.5. 

The Press Director shall assist the activity of all official press publications and other media sources of the KCA.

30.6. 

The Press Director shall be responsible for media accreditation at all official KCA's events.

30.7. 

The Press Director shall closely cooperate and consult with the KCA's President on his actions and decisions.

30.8. 

The rights and duties of the Press Director shall be as designated by the Statutes and the By Laws of the KCA.

 

 

31.  

Commissions

31.1. 

The Commissions shall be the assisting bodies of the Directing Committee, which are created by the President of the KCA and fulfil assignments of the President of the KCA and the Directing Committee.

31.2. 

The Commissions shall consist of a fixed number of members depending on the nature of activity. The Chairmen and the members of the Commissions shall be appointed by the President of the KCA, and their terms of office shall be designated by the President of the KCA.

31.3. 

The Chairmen and the members of the Commissions shall not be the members of neither the Congress nor the Directing Committee of the KCA. The Chairmen and the members of the Commissions may take part and speak at the meetings of the Congress and the Directing Committee, but not to vote.

31.4. 

The Directing Committee in the respective By-Laws shall specify roles and functions of each commission.

31.5. 

The KCA may have the following Commissions:

  • Auditors Commission
  • Kurash Development Commission
  • Refereeing Commission
  • Coaching Commission
  • Medical Commission
  • Press Commission
  • Commission on registration of the KCA in international sport organizations
  • Commission on legal issues

31.6. 

The rights and duties of the Commissions shall be as designated by the Statutes and the By Laws of the KCA.

 

 

   General Rules Of Holding Of KCA Official Events

32.  

General Principles

32.1. 

All NKF, their members and affiliated clubs shall participate only in those Kurash competitions approved by the KCA.

32.2. 

However, with the permission of the President of the KCA, NKF may participate in other events if these events contribute to promotion of Kurash, especially in countries, which are not KCA members.

32.3. 

The International Kurash Rules shall apply to all official KCA events, which include World and Continental Championships, International Kurash tournaments, competitions organized by the CKF and the NKF in the weight and age categories reflected in the International Kurash Rules.

32.4. 

If necessary the KCA's President shall appoint officials to supervise the observance of the International Kurash Rules at the KCA's official events.

32.5. 

Athletes shall not have the right to be members of the team of countries unless they are citizens of said countries.

32.6. 

The invitation of an athlete to participate at an event shall be made by the KCA or the CKF through the National Federation, which the athlete is a member of.

 

 

33.  

KCA's Official Events

33.1. 

All competitions included to the KCA calendar shall be KCA's official events.

33.2.

The Continental Championships shall be held annually under the supervision of the KCA and shall be organized by the host NKF selected at the Congress of the respective CKF. The CKF with prior permission of the Directing Committee of the KCA may change the frequency of holding of Continental Championships.

33.4. 

Other International Kurash tournaments may be held by any NKF only if these tournaments are not titled as "World" or "Continental".

33.5. 

Any NKF officially affiliated to the KCA shall have the right to apply for holding of the KCA's official event. For that the NKF shall send the said application to the General Secretary at least six months before the date of the next Congress.

33.6. 

The report about each KCA's official event shall be submitted by the host NKF to the General Secretary within one month after the conclusion of the event.

 

 

34.  

Doping

34.1. 

The use of any substances designed to artificially increase the performance of an athlete shall be strictly forbidden by the KCA.

34.2.

The decisions concerning penalties for doping abuse shall be based on the international anti-doping regulations and shall be made by the KCA's Directing Committee.

 

 

   Special Provisions

35.  

Tribunal

35.1. 

In case of a legal dispute arising from or in connection to the Statutes, the By-Laws or any other rules of the KCA, the parties shall do their best to settle matters amicably.

35.2. 

If the dispute is not settled amicably, the decision made by the Congress of the KCA or by a Court of Arbitration shall be final and binding upon all the concerned parties.

 

 

36.  

Internal Regulation

36.1. 

In accordance with the Statutes and the By-Laws of the KCA the Directing Committee shall be authorized to establish the internal regulation.

 

 

37.  

The Statutes of the KCA, changing and amending the Statutes

37.1. 

The Statutes of the KCA shall be the main document for all the members and organs of the KCA.

37.2. 

Proposals to change and amend the Statutes of the KCA shall be submitted by the President of the KCA and the Director on legal issues of the KCA to consideration by the Congress of the KCA. The Congress of the KCA shall have an exclusive privilege to approve any change and amendment to the Statutes of the KCA. All amendments and changes to the Statutes of the KCA shall come into effect right after their adoption by the KCA's Congress. The changed parts of the Statutes shall lose their power from the moment such changes are made by the Congress of the KCA.

37.3. 

In cases, which are not stipulated by the Statutes, the President of the KCA shall make the decision.

37.4. 

Decisions made by the Congress, the Directing Committee and Commissions of the KCA, the CKF and the NKF and any other organs of the KCA shall fully comply with the KCA's Statutes.

 

 

38.  

Dissolution of the KCA

38.1. 

The decision on dissolution of the KCA shall only be made at the Congress meeting by the unanimous vote of all the members of the Congress.

38.2. 

Exclusive right over the use of any funds or properties belonging to the KCA shall be granted by the Congress after obtaining the resolution on
